PRIVACY POLICY

Welcome to StudyPlace®, provided by GatherWorks, Inc. ("GatherWorks," "we," or "us"). Protecting your privacy is very important to us. This privacy policy (this "Privacy Policy") sets forth our policy with respect to information collected by us from users of StudyPlace, our web-based homeschool organization information management and enrollment software system ("StudyPlace").

As used in this Privacy Policy, "you" refers to you as a user of the GatherWorks website through which you access and use StudyPlace in any of the following capacities:
  • a homeschool organization, entity or individual paying for access and use of StudyPlace ("Customer");
  • a teacher, administrator or donor of the Customer accessing or using StudyPlace at Customer's request or through Customer ("Customer Agent"); or
  • a student or family member thereof to whom the Customer makes available access to and use of StudyPlace ("Customer Member").
StudyPlace is hosted at www.StudyPlace.us. Each Customer that uses StudyPlace will have its own website either hosted at a different domain or by GatherWorks. If you are using StudyPlace through a Customer, you must read any privacy policy of such Customer, separate and apart from this Privacy Policy, to determine the manner in which the Customer may use information you provide. Likewise, this Privacy Policy does not govern or control the privacy practices of third party websites to which we may provide links.

By using StudyPlace you are consenting to our collection and use of your information as described in this Privacy Policy which may be updated for any reason at any time. Your continued use of StudyPlace following the posting of an updated Privacy Policy will mean that you agree to those changes. Therefore, you must check this Privacy Policy frequently for updated information.

INFORMATION COLLECTION AND USE

GatherWorks collects information that can be used to identify and contact you ("Individual Identifying Information") in connection with your use of StudyPlace. We use this information for the following general purposes: (1) to customize the content you see, (2) to fulfill your requests for certain products and services, (3) to display personal account information, (4) to report enrollment information, and (5) to contact you about specials and new products.

GatherWorks receives membership information, including Individual Identifying Information, from the Customers that use StudyPlace. The membership information we collect from the Customers using StudyPlace includes, but is not limited to, family name, parent names, student names, contact information for each member of the family, gender, birth dates, graduation year, and grade range. This information is input by Customer Members, stored on the Customer's database and made accessible to GatherWorks for use in connection with StudyPlace.

StudyPlace also provides a family directory for the use of the Customer and its membership. The directory provides contact information for each family, including the following: last name, parents' first names, childrens' first names, address, primary phone number, and primary email address. During the account creation process, families can choose not to be listed in the directory. If a family chooses not to be listed, then the family's contact information will not be listed in the directory and the family will not be able to access the directory.

As part of ongoing efforts to improve StudyPlace, we will track and log information based on your usage of StudyPlace including, but not limited to, number of family members enrolled in courses, which courses they enroll in, how much money they spend on courses, and what payment options they choose.

Information Collected from Browser:

StudyPlace also automatically receives and records information in our server logs from your browser including your IP address, StudyPlace cookie information, the pages you requested, as well as CPNI, or "Customer Proprietary Network Information", which is defined in Section 222 of the Telecommunications Act of 1934 as:
[list][*]Information that relates to the quantity, technical configuration, type, destination, location, and amount of use of a telecommunications service subscribed to by any customer of a telecommunications carrier, and that is made available to the provider by the customer solely by virtue of the carrier-customer relationship; and
[*]Information contained in the bills pertaining to telephone exchange or telephone toll service received by a customer of a carrier

Information Collected from Cookies:

In addition to the Individual Identifying Information that StudyPlace actively collects when you visit our website, we also collect anonymous information passively using cookies. Cookies are pieces of information that websites transfer to your computer's hard drive for record-keeping and similar purposes. StudyPlace uses both session cookies and persistent cookies to make visiting our site easier and allow us to save your passwords and preferences so you can avoid having to re-enter them each time you visit. Cookies also help us to collect anonymous click-stream data for tracking user trends and patterns.
Most browsers are initially set-up to accept cookies, but may be configured to either to notify you when you've received a cookie or to refuse to accept cookies. You should understand, however, that if you don’' enable cookies certain functions of StudyPlace may not work properly.

Information Collected for System Billing and Improvement:

StudyPlace routinely time-stamps and logs events (like successful enrollments, payments made to school for enrolled classes, problems that arise during enrollment process and more). This data is used for accounting/billing purposes as well as for performance tuning and optimization of the StudyPlace services.

INFORMATION SHARING AND DISCLOSURE

GatherWorks will not share Individual Identifying Information with third parties, except with your express written consent or otherwise as set forth in this Privacy Policy.

System Demonstrations:

We may share aggregated information that does not identify Customers or include Individual Identifying Information with third parties for the purposes of demonstrating StudyPlace to prospective Customers.

We may periodically request permission from Customers to disclose their course names, course content and information that identifies such Customer and/or its Customer Agents for the purposes of demonstrating StudyPlace to prospective new customers. In the absence of such permission, we will not disclose such information in connection with demonstrations of StudyPlace. In no event will such demonstrations disclose Individual Identifying Information of Customer Members.

Law Enforcement:

GatherWorks cooperates with government and law enforcement officials to comply with the law. We may disclose information if we believe it appropriate and necessary to respond to claims, legal matters, protect our rights, and to prevent illegal or unethical behavior.

Successors:

In the event that the ownership of the business of GatherWorks or StudyPlace is acquired by a third party (whether by merger, asset purchase, equity purchase or otherwise), your Individual Identifying Information may be provided to such third party. Additionally, your Individual Identifying Information may be provided to a third party in connection with the negotiation of any such transaction if such third party agrees in writing to maintain the confidentiality of such information.

REMOVING OR CHANGING PERSONAL INFORMATION

Customers:

The contact information of a Customer's representatives can be changed/updated by logging into the Customer's account and editing the representative's contact information under Account Preferences. To delete or deactivate a Customer's participation in StudyPlace, please contact info@StudyPlace.us.

Customer Members:

If Customer Members wish to change/update their Individual Identifying Information, they may do so by logging into their account and editing Family Details. To change their username and unique name, Customer Members must contact the administrative personnel of the Customer. Likewise, if a Customer Member wishes to delete or deactivate participation in StudyPlace, the Customer Member must contact the Customer and inform the Customer. Deleting information from StudyPlace may result in canceling course enrollments.

SECURITY

The security of your personal information is important to us. When you enter sensitive information (such as a credit card number) for billing purposes, our third party payment processor encrypts that information using secure socket layer technology (SSL). We follow generally accepted industry standards to protect the Individual Identifying Information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee that it will remain secure at all times.

We will disclose any known breach of the security, confidentiality, or integrity of your unencrypted electronically stored personal data to you via email or conspicuous posting on StudyPlace website promptly, taking into account the needs of law enforcement or any measures necessary to determine the scope of the breach and restore the reasonable integrity of StudyPlace.

SYSTEM EVENTS

We track certain occurrences that affect StudyPlace for billing information in order to understand what features are being utilized and we track certain remote system information to better understand market trends.

CUSTOMER TESTIMONIALS

If you give permission to StudyPlace to post your quote or testimonial (print, audio, or otherwise), any Individual Identifying Information that is included in your quote or testimonial can be read, collected, or used by other users of StudyPlace forums, and could be used to send you unsolicited messages. We are not responsible for the Individual Identifying Information you choose to submit in these forums.
